The Problem with Handheld Breathalyzer Tests

Although a handheld breath test, also know as a portable breath test, is admissible in other states, it is not admissible at trial in Mass.

And the reason is it is simply not an accurate test.

It is a tiny machine kept in trunk of a car and subject to dust, extreme vibration and wide fluctuations in temperature and humidity.

If you've failed a handheld breath test, do not despair, it cannot be used against you at trial.
