First I admitted to the Trooper I had 2 beers; then I told him 4. The Police Report said  I had slurred speech, glassy eyes, was unsteady, failed  to touch my finger at the spot he told me to, couldn't keep my foot up for 30 seconds, didn’t walk heel to toe like he showed me, and couldn’t say the alphabet. In other words, I failed all the field tests. As an experienced Mass DUI Lawyer, Joe told me I could win anyway and advised we go to Trial. On his very first day in court Joe reduced my bail by $3000 and came prepared with a written motion to the Haverhill police department to order them to preserve my booking video. Next he convinced a judge to overturn my 5 year suspension for refusing the breath test. Now I was driving legally again awaiting trial. At trial, he argued that I looked so good on the video I never would have told the cop I was drunk. The jury asked to see the video a second time then acquitted me three minutes later. He saved me from a felony conviction, mandatory jail and 13 years with no license.

3rd OFFENSE REDUCED TO 2ND: NO 6 MONTH JAIL TERM
My client blew an over limit .15 breathalyzer after a bad accident. Charged with his third offense, he faced a mandatory jail sentence of at least six months and an 8 year loss of license. I stressed to the DA that his 2 priors were from out of state and the Commonwealth would have a difficult time proving my client was the same man convicted there. The DA immediately agreed with me and reduced the charge. Result: No jail time.
 
COLLEGE GRAD WHO COULDN'T RECITE ALPHABET ACQUITTED

A summa cum laude UMass grad was speeding 87 mph in a 65 mph zone, couldn't say the alphabet and failed all four field sobriety tests. Then the cop testified he had crossed the center line by "a foot and a half" for "10 to 12 seconds" at least "two to three times." On cross exam, I asked him to underline the sentences in his Report where he recorded any of those assertions. Not even one was in his Report and he lost all credibility with the Judge.
