I admitted to drinking "4 beers and a Mai Tai." Officer testifed he saw 3 lanes violations, that I had slurred speech, and bloodshot glassy eyes. Joe proved to the jury my fine motor skills were normal and I was able to exit my car and walk normally as well thus creating reasonable doubt. After the not guilty verdict, he even convinced  the judge to overturn my 3 year refusal suspension and restore my license.

Cop saw 3 lanes violations, testified client had slurred speech, bloodshot, glassy eyes, first said he had "4 beers," then later "4 beers and a Mai Tai." I got cop to admit client had no difficulty finding and delivering his license and registration, thus his fine motor skills were normal. Plus he had no difficulty exiting the car and walked fine. After the not guilty verdict, I convinced Judge to restore his license which had been suspended for 3 years for refusing the breath test.

I was charged with OUI and child endangerment which carries a mandatory jail sentence if I was convicted. I had no idea where to turn and was lucky I found attorney Waldbaum. 3 YEAR REFUSAL SUSPENSION OVERTURNED

Client was a second offender and refused to take the breathalyzer test when he got to the police station. Because of his refusal, the RMV suspended him for three full years. I appealed the RMV's decision to a judge in Court and convinced the judge to restore the client's license. This saved him three full years with no license whatsoever because no hardship license is available during the refusal suspension.

FAILED BREATH TESTS - NOT GUILTY AT TRIAL

Melanie’s Law dictates if you blow .08 or over you are guilty of OUI. Period. Client had blown .09-- twice, admitted to coming from a bar and having four drinks over the past hour. Plus, the cop didn’t like the way he did the field sobriety tests. I advised him not to plead guilty and not to have a Jury Trial. We did so and he received a Not Guilty -- despite the two over limit breath tests.

My son was facing his second offense OUI in one year. Joe said we could win the case and patiently explained everything to us every step of the way. Ultimately he obtained a not guilty and then even convinced the Judge to overturn his three year suspension for refusing the breathalyzer --something we never expected. Now I can finally stop chauffeuring him around!
