Six years ago I had my first OUI, used a different lawyer and took a guilty plea. Last year I got my second OUI which seemed impossible to win. The 3 year loss of license for the breath test refusal meant the loss of my job. It would affect my marriage and the rest of my life. I thank God I called Joe who calmed my fears and got my license back n a few weeks so I could drive legally for the 9 months it took to go to trial. I was stopped for speeding and a bunch of cops showed up. I was extremely nervous and they said I failed all the field sobriety tests. Joe was in Court for me the very next day AND the next three Court dates which greatly relieved my anxiety. He educated me about the process and was at all times helpful, professional and responsive. At the Motions hearing, he methodically documented an extensive laundry list  of things the Trooper had done all wrong. Once the Judge allowed his Motion to Suppress evidence, the DA dismissed the case, writing "there is insufficient evidence to proceed with the prosecution at this time." The OUI charge against me was dismissed and my license was restored immediately.

I am a free man! I was arrested for my 3rd offense in 1990 but was in default for 23 years and didn't drive. After calling Joe, he reviewed the RMV and old court records and gave me detailed instructions on how to apply for a license again and 3 weeks later I was driving. Plus, he said he believed the old court records were insufficient for the DA to prosecute me and he was right: they dropped the charges on the next date. Trooper saw me commit multiple lanes violations and blow through a Yield sign without slowing down. Then he testified I had slurred speech and had difficulty getting my registration out of the glove box, was unsteady on my feet exiting the car and had an ‘overwhelming odor of alcohol’ on my breath. After seeing the Police Report, my wife didn't think he could win it but Joe told me to try the case anyway. He was reassuring at all times and both amazing and incredible at Trial.

Police noticed a parked car facing the wrong way on a one-way street and found client sleeping inside. He took over 3 minutes to find his license, was unsteady on his feet after getting out of the car and failed all roadside tests, including one-leg stand and walk and turn. We convinced the judge that the late hour and very cold weather affected his performance on the balancing tests. The judge agreed there was reasonable doubt and found him not guilty. The judge then immediately allowed our motion to restore his license, overturning his 3-year refusal suspension. Now he's driving legally again and supporting his family.

Cop found Jose asleep in his car facing wrong way on a 1-way street. He couldn't find his license for 3 minutes. Then he failed the one leg stand and 9-step walk and turn tests. We immediately filed a motion to preserve the booking video.

At trial, I convinced the judge the extremely cold weather [cop's pen stopped working!] and the lateness of the hour explained his performance at roadside. Plus, his good appearance on the booking video created reasonable doubt. The judge found him not guilty and lifted the three year refusal suspension so he's driving again and kept his job.

Client was arrested for his second OUI charge and wisely refused the breathalyzer test at the police station. The Registry immediately suspended his license for three full years. We guided him through the complex process of fighting this at the RMV [which must be begun in fifteen days] and then on appeal to a judge in court who reversed the RMV and restored his license [see link below]. He was then able to drive legally while the case proceeded towards trial.

It was a bad accident. I hit a parked car, drove it onto the sidewalk into a set of stairs and structurally damaged them. Then I admitted to the cop I had “a few." He testified I smelled of alcohol, was unsteady, had bloodshot, glassy eyes and failed the field tests. They even video recorded me doing them [and not very well!] back at the station house. No matter. Joe told me he could win the case at Trial and that's exactly what he did. No fines, no Probation, no alcohol programs, nothing.

The defendant had already pled guilty to OUI 2nd offense in Boston and had his license suspended for five years. Foolishly, he drove before the suspension expired and was arrested and charged in Somerville with operating after suspension for OUI. This charge carries a mandatory jail sentence of 60 days. This was further complicated because he was still on Probation in Boston and could be sent to jail by that Court merely for getting arrested again.

I first represented him while he was being held in jail at Somerville. I went sidebar and informed the judge that he was suffering from AIDS and complications and took 2-3 dozen medications per day. In other words, incarceration would likely kill him. The Judge convinced the DA to reduce the charge to mere Operating after Suspension and he received only a fine and was immediately released from jail and into my custody.

Then I represented him at his Probation Violation Hearings in Boston and managed to avoid the jail sentence from being imposed there as well.

Attorney Waldbaum is an amazing lawyer. I was charged with OUI-Drugs 2nd offense and 3 drug charges- also my 2nd offense. I caused an accident and my case looked impossible to win.
